In a recent case, Brown Trial Firm, PLLC won $480,000 on behalf of a U.S. veteran and civilian mailroom clerk who had suffered severe injuries following a mishandled prostatectomy. After being diagnosed with low-risk prostate cancer in 2009, the then-52-year-old veteran underwent robot-assisted surgery to remove the cancer, after which he suffered from additional pain, fever, and abdominal distention. A CT scan was performed, but the radiologist determined the post-operative changes were “nonspecific” and that a follow-up CT scan would be performed to identify rectal injury.
The follow-up CT scan was never ordered or scheduled.
Over the next year, the veteran suffered ongoing abdominal and rectal injuries that required repeated hospitalization and multiple surgical operations. A surgeon later determined that the veteran’s injuries probably occurred during the initial prostatectomy.
The veteran sued the United States for the medical staff’s failure to test for rectal injury during and after the prostatectomy, discharging him prematurely from the hospital, and failing to diagnose the potentially fatal rectal and abdominal injuries.
