In 2012, the driver of a full-size pickup truck made an unsafe right U-turn on State Highway 29. The truck driver had been parked on the side of the highway and had taken a call from his construction crew on his cell phone. When the driver attempted the right U-turn onto the highway, he crossed the center line into the westbound lanes and into the path of a minivan carrying four people.
The 57-year-old woman driving the minivan and her three passengers, her mother and two granddaughters, suffered serious injuries that required extensive medical treatment and rehabilitation. The driver of the minivan died in the hospital shortly after the accident.
The deceased woman’s family filed a wrongful death claim against the truck driver and his construction company because the driver was acting within the scope of his employment when the collision occurred.
The family sought damages for past and future mental anguish, loss of companionship, and past medical bills. The case settled in mediation before going to trial for $5,500,000 awarded to the decedent’s family.
